Any law enforcement can take "advantage" of any laws this does not mean we should not have them, if your not a suspected terrorist and not having communications with them, you have nothing to worry about. Protecting citizens is in the constitution.
Your argument only holds weight if the government hasn't lied.

the military spends billions of the taxpayers money on tanks, fuel, gun, ammunition, supplies, ect. All of these things add up to billions if not trillions when all is said & done.
War is a racket. It is always about money, and war benefits the bankers, because they always loan governments the money to wage the wars.
Banks are a buisness that profit by loaning fiat currency (paper) at interest. This money is created out of thin air on a keyboard
And all the wars since Korea can be deemed unconstitutional and hence illegal, because congress never declared war in the manner that the constitution mandates.
Congress must declare war. The Constitution doesn't allow us to go to war under UN resolutions.
The Iraq war is illegal under these conditions as well.
